Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Orakle ("Orakle"), including the Orakle REST API, SDKs, MCP server, dashboard, and related services (the "Services") provided by Optima Engineering LLC ("Optima"). This AUP is incorporated into and supplements our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service. Violations of this policy may result in suspension or termination of your access to the Services.
You are responsible for ensuring that your use of the Services, including all activity by your authorized users and by any application or system that calls the Services under your account or API keys, complies with this policy.
1. Universal Prohibited Uses
You may not use the Services, directly or indirectly, to engage in or facilitate any of the following:
Illegal and Harmful Activities
- Any activity that violates applicable federal, state, local, or international laws or regulations.
- Pricing, valuing, or facilitating the sale or resale of goods whose manufacture, sale, possession, or resale is unlawful in any applicable jurisdiction, including stolen goods, counterfeit goods, and contraband.
- Pricing or trade in weapons, controlled substances, hazardous materials, wildlife, or other regulated items where such activity is prohibited or not properly licensed.
- Money laundering, sanctions evasion, fraud, or other financial crimes.
- Harassment, threats, or intimidation of individuals or groups.
Infringing and Deceptive Activities
- Submitting product descriptions or other inputs that infringe the copyrights, trademarks, patents, trade secrets, or other intellectual property or proprietary rights of any third party.
- Using the Services to value or facilitate the sale of counterfeit, pirated, or knowingly misdescribed goods.
- Generating false or misleading content, fake listings, fabricated appraisals, or deceptive pricing claims.
- Misrepresenting Pricing Outputs as guaranteed prices, official appraisals, or human-prepared valuations.
- Using Pricing Outputs to manipulate markets, coordinate pricing unlawfully, or engage in anticompetitive conduct.
Privacy
- Using the Services to profile, track, or surveil individuals.
- Aggregating personal data to build profiles based on protected characteristics.
No Personal Data in Pricing Queries
The Services are designed to price products, not people. Product descriptions and other inputs you submit to the pricing API, SDKs, or MCP server ("pricing queries") must describe goods only. You must not submit personal data, payment card data, government identifiers, or other sensitive information about any individual as part of a pricing query. Examples of prohibited content include names, contact details, account numbers, and any text that identifies or could reasonably identify a natural person.
Pricing query content is not intended to contain personal data, and you are responsible for removing or redacting any such data before submission. Account, billing, and authentication information you provide to Optima is handled separately under our Data Processing Agreement and is not affected by this restriction.
2. API and Platform Integrity
The Services are delivered through a web dashboard and documented programmatic interfaces (REST API, SDKs, and MCP server) and must be used only through those supported interfaces. You may not:
- Scrape, crawl, harvest, or use automated means to extract data from the Services, the website, or the dashboard other than through the documented API in accordance with the Terms of Service.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, model weights, training data, or underlying structure of the Services or the pricing model.
- Probe, test, or attempt to circumvent the authentication, rate-limiting, quota, or billing mechanisms of the Services.
- Exceed, evade, or attempt to evade the rate limits or token allowances applicable to your subscription tier. You must respect documented rate limits and quotas and implement reasonable back-off and retry behavior.
- Impose unreasonable or disproportionate load on the Services or interfere with or disrupt the experience of other customers.
- Create multiple accounts, or use automated means to create accounts, to circumvent usage limits, quotas, free allowances, or enforcement actions.
- Share, resell, or sublicense your account access or API keys to unauthorized parties.
- Access the Services for the purpose of competitive analysis, benchmarking, or building a competing product or model.
3. Restrictions on Pricing Outputs
Pricing Outputs are licensed to you for your internal business purposes as described in the Terms of Service. You may not:
- Resell, redistribute, sublicense, syndicate, or otherwise make available raw or substantially unmodified Pricing Outputs as a standalone data product, dataset, price feed, or service that competes with the Services.
- Use Pricing Outputs, or data derived from the Services, to train, fine-tune, calibrate, or build a competing pricing or forecasting model.
- Cache, store, or republish Pricing Outputs in a manner that functions as a substitute for accessing the Services.
- Misrepresent the source, accuracy, or nature of Pricing Outputs, or remove or obscure any disclaimers accompanying them.
4. Responsible Use of Estimates
Pricing Outputs are probabilistic estimates and forecasts, not guaranteed prices or financial, investment, tax, or legal advice. To use the Services responsibly:
- No sole reliance for high-stakes decisions: you must not use Pricing Outputs as the sole basis for any high-stakes financial decision, including lending, underwriting, collateral valuation, large-scale procurement, investment, or financial reporting decisions. Such decisions require independent verification and, where appropriate, review by qualified professionals.
- Human judgment: apply your own commercial judgment and corroborating information before acting on a Pricing Output.
- Disclosure: where you present Pricing Outputs to end users or third parties, do not present them as definitive prices, guarantees, or appraisals, and make clear that they are estimates.
- No regulated advice: do not use the Services to provide investment advice, securities valuations, or other regulated financial services unless you are properly licensed and independently satisfy all applicable regulatory obligations.
5. Export Controls and Sanctions
You may not use the Services in violation of applicable export control laws or economic sanctions, including those administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the U.S. Department of Commerce, the European Union, or the United Kingdom. You represent that you are not located in, organized under the laws of, or a resident of any country or territory subject to comprehensive U.S. sanctions, and that you are not designated on any applicable restricted party list.
6. Reporting and Enforcement
Reporting Violations
If you become aware of any use of the Services that violates this AUP, please report it to legal@optima.engineering. We reserve the right to investigate reports and take action in our sole discretion.
Enforcement Actions
If we determine that you have violated this AUP, we may take any action we deem appropriate in our sole discretion, which may include:
- Issuing a warning and requesting remediation.
- Throttling, rate-limiting, or restricting access to features.
- Suspending your account pending investigation.
- Terminating your account and access to the Services.
- Reporting the activity to law enforcement at our discretion or as required by law.
We may act immediately with or without prior notice. We are not required to provide notice of enforcement actions.
7. Changes to This Policy
We may update this AUP at any time in our sole discretion. Updated versions will be posted on our website. All modifications are immediately binding upon posting. We are not obligated to notify you of changes. It is solely your responsibility to review this policy regularly. Your continued use of the Services constitutes your acceptance of the then-current policy.
